GMB Union (No 1) v Corrigan - Acting General Secretary does not necessarily hold post of General Secretary [2007] EAT

It is a legal requirement that the person who holds the office of General Secretary in a trade union must be elected to that post (TULR(C)A 1992 s.46). The GMB suspended its General Secretary Mr Curran in March 2005. He resigned. A long investigation followed into electoral malpractice. Meanwhile a Mr Kenny was made Acting Gen. Sec. The investigation led to procedural changes and Mr Kenny was finally elected as Gen.Sec in May 2006.
