GMB Union & Others v Hughes & Others - Orders were not perverse by reference to relevance, proportionality and confidentiality [2009] EAT
Messrs Hughes, Beaumont and Hoggarth were ex-employees of trade union GMB. They were dismissed over their involvement, and employment tribunal findings against them, in a claim of sex discrimination brought by a Ms Nixon. This apeal concerned only Mr Hoggarth's case, and related to Orders made at a Case Management Discussion (CMD) by an Employment Judge that GMB disclose:
- a list of all officers of the GMB by region and head office who have received in excess of one year’s sick pay and the nature of their illness;
- a list of all officers of the GMB by region and head office who have been afforded ill health retirement and the nature of their illness;
- a list of all GMB officers by region who have had their case for dismissal referred to the Regional Committee by the Regional Secretary; and
- a list of all officers by region who have been allowed to appeal to the CEC against dismissal.
