GMB Union v Brown - insistence on strict compliance with grievance procedures can amount to breach of trust and confidence - EAT 25.9.07
Ms Brown resigned from her post with GMB and claimed constructive dismissal. GMB procedures had required her to attempt to resolve her grievances by meeting with her manager. The Newcastle employment tribunal agreed with her that as the manager was the perceived source of her problems GMB's refusal to allow an amended process amounted to breach of the implied term of trust and confidence. GMB appealed.
