GMB Union v Ms J Brown - Insistence on strict compliance with grievance procedures can amount to breach of trust and confidence  EAT
Ms Brown resigned from her post with GMB and claimed constructive dismissal. She argued that she had become too ill to resolve her grievances by way of meeting with her line manager (the perceived source of her problems), which the GMB procedures required. The tribunal accepted her argument that GMB's failure to allow her to follow an amended process amounted to breach of the implied term of trust and confidence. GMB appealed.
