Gorai v Patel - EATupholds constructive unfair dismissal decision - EATon 27.7.07

Mrs Patel was practice manager at a medical practice in which her husband, Dr Patel, used to work. Dr Gorai took over the practice in January 2005 in "circumstances where the employment of the Claimant and other staff members transferred to" him. She and Dr Gorai did not get on. She brought and won claims for constructive unfair dismissal and unpaid sick pay at the Stratford East employment tribunal against Dr Gorai., alleging that he was in breach of the implied term of trust and confidence. Dr Gorai appealed to the EAT but his appeal has been dismissed.
