Gosnold v BA Security Ltd - Dismissal was admitted, and so not an issue in the proceedings that tribunal could make different finding upon [2011] EAT

Where the fact of dismissal is clearly (and correctly) admitted in the pleadings it is not an issue in the proceedings. An employment tribunal has no right to open it as an issue of its own volition, and make findings on it to the effect that there was no dismissal, without at least giving the claimant an opportunity to address it.
