Governing Body Of Wishmorecross School v Balado - "Conditional dismissal" amounted to notice of termination of employment [2011] EAT
An employee who is told that they will be dismissed if either (a) they fail to appeal or (b) their appeal is unsuccessful has, effectively, been "conditionally dismissed". Such conditional dismissal constitutes "notice of termination" and a tribunal has jurisdiction to hear an unfair dismissal claim presented after that date but prior to any eventual effective date of termination.
