Grant v McKechnie Plastic Components - EAT appears to misunderstand the HL judgment in SCA Packaging Ltd v Boyle

The House of Lords ruled in SCA Packaging Ltd v Boyd , in July 2009, in the context of a Disability Discrimination Act 1995 case that "likely" means "could well happen". In this case, the EAT appears to have misunderstood that House of Lords judgment.
