Grattan Plc (1) Hobbs (2) v Kayat (1), Coulson & others - Appeal allowed due to fundamental errors of reasoning by tribunal [2008] EAT

Mr Kayat was off sick for over a year. There was some dispute between him and his employer Grattan over obtaining medical evidence, and more than a degree of non-cooperation from Mr Kayat. Eventually, because Grattan could not obtain up-to-date medical information it decided to dismiss Mr Kayat due to his continuinig sick absence. An employment tribunal held that Mr Kayat was unfairly dismissed and suffered racial discrimination in a number of respects. Grattan appealed as did Mr Kayat on those areas where his original claim failed.
