Green v Metroline London Northern Ltd - Unfair dismissal, contributory conduct and failure to mitigate loss  EAT
Mr Green, a bus mechanic, won an unfair dismissal claim. The employment tribunal found that he was 20% responsible for his dismissal. It also found that he had failed in his duty to mitigate his loss by searching for comparable employment and that he would have found other comparable employment quickly and easily and that therefore he should receive nil compensation in respect of future pension loss.
Mr Green appealed against both findings. The EAT has dismissed his appeal.
