Griffin v Plymouth Hospitals NHS Trust - Approach to calculation of pension loss [2011] EAT

Whether pension loss should be calculated using the "simplified approach" or the "substantial loss approach" (as contained within the Guidance for tribunals) should be decided on the facts of each individual case, rather than on any hard and fast rules.

Mrs Griffin was a Specialist Clinical technician, contracted to work 33.5 hours per week, and a member of the Trust's final salary pension scheme. She developed lupus, and after a period of absence returned to work for 25 hours per week, but was unable to continue and her employment was terminated
