Harlow District Council v (1) O'Mahoney (2) APS Recruitment Ltd - Employment of agency worker by end user "necessarily implied" EAT
Yet another of the "triangular" employment cases (such as Dacas, Muscat and James). APS Recruitment provided Mr O'Mahoney to work as a plasterer for Harlow DC. APS paid his wages. When HDC ended his work an employment tribunal concluded that he had in fact been HDC's employee and that they had unfairly dismissed him. HDC appealed but lost.
