Hawes & Curtis Ltd v (1) Arfan (2) Mirza - Internal appeal process moved the EDT [2012] EAT

In cases where where the decision at an internal appeal results in a change of the date on which the employment is terminated, that decision is to be taken into account in determining the EDT.

Mr Arfan was employed by Hawes & Curtis Ltd (HCL), a shirt retailer, as manager of the Liverpool Street Station shop; Mr Mirza was assistant manager. Both were dismissed summarily for gross misconduct. on 5th October 2010. HCL had identified a stock shortfall amounting to about £144,100. After a thorough investigation HCL was able to identify a group of individuals who were culpable, which included the two Claimants. Messrs Arfan and Mirza appealed against their dismissals. Although those appeals failed, the date of termination was moved to 4th November. Both were paid until that date, and no party considered the payments to be either notice or ex gratia payments.
