Henry v (1) London Borough of Southwark (2) South London & Maudsley NHS Foundation Trust - dispute resolution procedures are not easy for a litigant in person and this can amount to "special circumstances" so as to allow a Review  EAT
Ms Henry, Southwark's employee, worked at Bethlem Royal Hospital which is managed by the Trust. She made a claim of race discrimination, which the employment tribunal dismissed. Southwark, in their response to her claim, had pointed out that her tribunal claim was made on 9 December 2006 but that Ms Henry lodged no internal grievance until 11 December 2006. Ms Henry referred to a "Complaint" made on 11 November 2006 - but this did not refer to race discrimination. She also mentioned a letter of 19 October 2006, but the judgment did not refer to this.
