Herring & anor v Co-operative Insurance Society Ltd - Rolled up holiday pay [2006] EAT
Mr Herring appealed against a tribunal order (i) refusing their application for an adjournment (ii) striking out their claims (iii) ordering them to pay £4725 employer's costs and (iv) refusing their application for costs.
He was employed on a small salary plus commission and "procuration fees" for new business and claimed that the result was that he was not paid properly for holidays as required by the Working Time Regulations 1998.
