Hiero v Changework Now Ltd - substantial adverse effect of disability must be judged without reference to medication

Mr Hiero suffered the anxiety condition dysphoria. When his job application was rejected he claimed disability discrimination, but an employment tribunal dismissed his claim on the basis that he was not a disabled person within the meaning of the Disability Discrimination Act 1995 (DDA). Mr Hiero appealed against this decision, arguing that he suffered a so-called "deduced disability" under DDA 1995 Schedule 1 para 6(1), which states that:
