Hoeppner v West Lothian Council - Statutory grievance procedure in constructive unfair dismissal claim [2009]

The question in this case was whether a claimant had complied with the statutory grievance procedures required until 6th April 2009 as a condition of bringing a constructive unfair dismissal claim before an employment tribunal.

In late 2008 in a case to which the pre-April 2006 statutory dispute resolution procedure rules applied, an employment tribunal found that Mr Hoeppner had not complied with the statutory requirements and therefore it had no jurisdiction to consider his claim of constructive unfair dismissal.  The EAT has dismissed Mr Hoeppner's appeal.
