Homeserve dismissed Mr Dixon for gross misconduct. The employment tribunal considered that Mr Dixon had 100% contributed to his dismissal by his actions. Even so, the dismissal was automatically unfair because Homeserve failed to follow the statutory dismissal procedures. Homeserve appealed.
