Honda of the UK Manufacturing Ltd v Gobby - before deciding on unfairness, tribunal must identify the reason for the dismissal
In a claim for unfair dismissal the Employment Tribunal should, in its reasoning, first decide the statutory question contained in the Employment Rights Act 1996 S.98(1) ie the reason or main reason for the dismissal. This is a matter fundamental to the assessment of the fairness of the dismissal.
