Hughes v Jones (t/a Graylyns Residential Home) - Working Time Regulations entitle worker to breaks following periods of time "on-call" regardless of whether she was actually called out [2008] EAT
Mrs Hughes worked as a care assistant. She was required to be "on-call" from 9pm to 8 am, and had accommodation provided at a heavily subsidised rent in light of this. In reality she would be called out perhaps twice a month. When given notice to quit the flat Mrs Hughes raised a number of complaints (primarily unfair dismissal).
