Humphries v Chevler Packaging Ltd - Time limit for claiming disability discrimination  EAT
Mrs Humphries left her employment, claiming unfair constructive dismissal and disability discrimination.
An employment tribunal held that a disability discrimination claim she brought was out of time. It ruled that time ran from the date the employer made it clear no further adjustment to her job could be made, rather than from the date of termination of employment. In other words, as a matter of law failure to make reasonable adjustments should not be regarded as a continuing act.
In the circumstances the tribunal held it would not extend time.
