Mrs Hyde-Walsh brought claims in an employment tribunal, winning some and losing others. In her appeal she raised a new issue, claiming that a report she had made (and referred to in her original tribunal claim) was a protected disclosure under Employment Rights Act 1996 s47B.The question was, could Mrs H-W run an argument before the EAT based on facts pleaded in her claim form but which were not advanced before the original tribunal because she did not know at that time that the argument existed?
