Mrs Ilori alleged that she had suffered race discrimination. Her complaints appeared to fall into two distinct groups, between 2002 and 2003 when she was denied promotion, and 2004 - 2006 where the issue related to performance monitoring action taken against her. An employment tribunal held that there was no continuing act and so the earlier complaints were out of time. Mrs Ilori appealed.
