Invectec (Scotland) Corporation Ltd v Duffy - Redundancy payment must be deducted from unfair dismissal compensation  EAT
Mr Duffy was made redundant. He received a redundancy payment of £8441.63. His selection for redundancy followed no proper selection procedures, so an employment tribunal found his dismissal unfair. It awarded him £17,187. This included a "basic award" of £2,465. His actual redundancy payment far exceeded this, but the tribunal refused to make any deduction to the "compensatory award" to allow for that. Invectec appealed.
