Ismail v Commissioner of Police of the Metropolis - Assumption of race discrimination EAT
Mr Ismail, a police officer, claimed that he had been the victim of a racially motivated assault by a colleague, Sgt Morgan. An internal investigation cast doubt on Mr Ismail's credibility and revealed no evidence of racist behaviour by Sgt Morgan. No disciplinary action was taken against him. Mr Ismail brought a claim of racial discrimination, alleging that both the investigation and its outcome had been tainted by racist considerations and that he was in effect being victimised for having raised a complaint in the first place.
