A & J Menswear (Retail) Ltd v Jacobs - employee ready and willing to work was entitled to be paid wages
An employee who has been told to stay away from work until further notice is nonetheless entitled to be paid as long as they remain ready and willing to work.
Mrs Jacobs brought an employment tribunal claim for unpaid wages following her resignation. On 15th July 2010 she was told not to come into work "until further notice" while an investigation was carried out, on 30th July she resigned giving one month's notice and so on 30th August her employment ended. No "further notice" was ever given.
