Jackson v Walsall Metropolitan Borough Council - Re extension of time for appeal [2005] EAT

Ms Jackson (an employed barrister) is bringing a whistleblowing claim, plus claims of sex and race discrimination, against her employer (due to be heard in February 2006). Her request that her employer be ordered to disclose certain documents was turned down by the tribunal. She wanted to appeal against that refusal but was out of time. The EAT now refused to extend the time. In doing so, the EAT pointed out strongly that the underlying merits of a case are usually of little importance in deciding whether to grant an extension of time for such an appeal.
