Jackson v Wigan MBC & anor - Unfair dismissal of school teacher  EAT
Ms Jackson was a teaching assistant. She lost an unfair dismissal claim she brought against her employers. However in finding against her the Employment Tribunal had failed to consider guidance under the Education Act 2002 which had been incorporated into her employment contract. This statutory guidance is required to be followed by school governors (it represents a continuation in less rigorous form of requirements set out in the School Standards and Framework Act 1998).
