James v Greenwich Council - is an agency supplied worker an employee? - EAT 18.12.06
Ms James was supplied by an agency to Greenwich Council. After some 5 years she took time off for sickness. The agency provided a replacement and Ms James claimed unfair dismissal against the Council. An employment tribunal dismissed the claim on the basis that she was not an employee of the Council. She appealed to the EAT and has lost. The main ground for the EAT ruling was that the tribunal's decision was not perverse.
