Jones v. Friction Dynamics Ltd & Ors - Dismissal or frustration of contract? [2007] EAT

Mr Jones, a machine operator, began working for Friction's predecessor Ferodo in 1973. In April 2001 he cracked two ribs in an accident and was given a six-month sick note. Shortly afterwards, his colleagues were called out on strike and he was warned that he would be dismissed unless he notified the company that he would be back at work on 27th June. He duly confirmed that he was being treated by his GP and that he would return as soon as he was medically able.
