Jury's Inn Group v Tatarova - Automatically unfair dismissal and "Polkey" [2010] EAT

A finding of automatically unfair dismissal following from an employer's failure to follow the (now repealed) statutory disciplinary procedures does not oust the possibility of making a Polkey reduction ("she would have been dismissed anyway even if proper procedures had been followed")

Miss Tatarova was employed by Jurys Inn Group as a cleaner in June 2004. She worked there until dismissed on 20th March 2009 for gross misconduct in lying about being ill and fraudulently receiving SSP.
