Kelly v University of Southampton - Mitigation of loss by unfairly dismissed employee [2010] EAT

In determining whether an unfairly dismissed employee has failed in her obligation to mitigate her loss it is not perverse for a Tribunal to look at the surrounding evidence of her skills and experience, as well as her track record with the same employer, in order to take a view as to whether she would have been offered an alternative job advertised by that employer if she had applied for it.
