Kent County Council v Knowles - Suspension must be with pay unless employment contract provides otherwise [2012] EAT

As long as an employee remains willing and able to work, any suspension from work without pay will amount to an unlawful deduction of wages unless provided for by his contract.

Mr Knowles, energy purchasing manager for Kent CC, was charged with misappropriating £20 million from British Gas. Obviously this had implications for the Council, which initially suspended him on full pay but then decided to withdraw his pay altogether pending their investigation. He was eventually dismissed summarily for gross misconduct.
