Appeal is only permissible on a question of law, not fact. There is no requirement on a tribunal to find that burden of proof shifted where there is no finding of discrimination on the facts.

Mr Khan, who was born in Pakistan, complained to a tribunal of 24 acts of discrimination under the race/religion or belief legislation. His claims were unsuccessful and he appealed against the finding on 11 of the 24 acts.
