Khan v Kirklees Metropolitan Council & ors - Race & disability discrimination claims dismissed with heavy costs [2007] EAT

Mr Khan appealed against (i) a tribunal order striking out his race and disability discrimination claims; (ii) a wasted costs order assessed at £3,000; and (iii) an order to pay 80% of the Council's costs, estimated at around £100,000. The EAT has dismissed all three appeals. The only point of general interest is that the EAT ruled that a technical error by the tribunal in applying the 2004 tribunal rules on costs rather than the 2001 rules was irrelevant.
