King v Royal Bank Of Canada Europe Ltd - Dismissal for redundancy no reason for tribunal not to consider remedy of reinstatement [2011] EAT

Having found a dismissal unfair, an employment tribunal is obliged to explain the remedies of reinstatement or re-engagement, when and how they are available, and establish whether a claimant wishes to pursue them. A finding that a dismissal was genuinely on grounds of redundancy does not remove the need to take this step: the situation with regard to possible vacancies may have changed between the dismissal date and the hearing date. 

Mrs King brought claims of unfair dismissal and sex discrimination, based on how she was made redundant from Royal Bank of Canada (RBC).
