Kirwan v First Corporate Shipping Ltd - Dismissal of shop steward and protected disclosure EAT
Mr Kirwan was employed by First Corporate Shipping. He was active as a trade union shop steward. He sought legal advice from well known Bristol solicitors, Osborne Clark, about what he considered was wrongdoing by his employers in connection with their pension scheme. He was subsequently dismissed, for persistent lateness. He claimed that he was really dismissed for having provided information to Osborne Clark, which he claimed was a "protected disclosure".
