Knight v Treherne Care & Consultancy Ltd - Unfair dismissal claim must focus on fairness of employer, not conduct of employee [2009] EAT

Mrs Knight was dismissed from her post as Finance Director at a Care home for gross misconduct, in that she had misrepresented the company's financial position to the Board. There was some form of hearing where allegations of financial wrongdoing were put to her, and she was suspended. At a resumed hearing theĀ Board put forward the reasons why it considered the allegations were proven, and subsequently Mrs Knight was sent a letter dismissing her. An appeal hearing upheld the dismissal.
