Komeng v Sandwell Metropolitan Borough Council - Tribunal's ruling on "disorganised and unsatisfactory training regime" was not clear [2011] EAT

A tribunal should be careful before ascribing less favourable treatment to an employer's poor administration: such failings may mask real disadvantage to individuals or certain groups of individuals.

Mr Komeng brought various claims of discrimination, on grounds of race and part-time status, against his employers, Sandwell MBC. His main contention was that he was denied access to training, in particular that Sandwell failed to place him on an NVQ course within a reasonable period of time.
