KRD Property Maintenance Ltd v O’ Donnell - Perversity [2010] EAT

A finding of unfair dismissal in relation to a misconduct dismissal is perverse where: an assumption of an Employment Judge - in the employee's favour - is not put to the employer; an Employment Judge contradicts their own standpoint as regards findings of fact; an Employment Judge suggests younger witnesses are less credible than older witnesses; some findings on procedural unfairness are not backed by facts; and an Employment Judge outlines that the employee is guilty of "blameworthy conduct" but not misconduct.
