Labinjo v The University of Salford - striking out
Striking out a claim for non compliance with an unless order intended to force the claimant to remove irrelevant documentation was inappropriate and excessive.
Mr Labinjo, the Claimant, was employed by Salford University, the Respondent, as a lecturer. In 2007 he issued ET claims for unlawful race discrimination, victimisation and harassment. The claims were settled and a compromise agreement was drawn up which stated that his employment would terminate by redundancy and which provided him with a termination payment and immediate access to his pension.
