Ladbrokes Betting & Gaming Ltd v Ally - Continuity of employment on dismissal followed by reinstatement [2006] EAT
When an employee appeals to his employer against a decision to dismiss him, in law he is treated as 'suspended without pay' until the internal appeal has been concluded. If, as in this case, the appeal is successful and he is reinstated he will therefore be entitled, subject to any contract term to the contrary, to full back pay for the period of the suspension. The Birmingham Employment Tribunal were wrong in law to hold the opposite.
