Ladbrokes Racing Ltd v Traynor - Procedure when amendment sought at hearing [2007] EAT
Mr Traynor claimed that he was unfairly dismissed. His ET1 claimed solely that the decision to dismiss him was, given his record, unreasonable. However, at the tribunal hearing he sought to cross-examine on procedural unfairness. Without giving reasons the tribunal allowed this. Ladbrokes appealed arguing that this was never part of Mr Traynor's case, they had not prepared for it, and it amounted to an amendment which should not be allowed.
