Lambert v Vicomte Bernard De Romanet Ltd - employee contributed 100% to his dismissal, albeit it was procedurally automatically unfair
Tribunal's findings of 100% contribution towards dismissal entitled it to make no compensatory award.
Wine Adviser Mr Lambert went sick in November 2005. There was little contact from him with the company, which tried to arrange meetings with him: eventually it wrote to him in March warning that if he did not respond it would take it that Mr Lambert had chosen to leave the company. No reply was forthcoming and so the company treated Mr Lambert's employment as having ended as of 26th March 2007.
