Lewis v New College Oxford - Tribunal failed to demonstrate open mind, and apparently reached conclusion before end of evidence [2011] EAT

Material errors by tribunal, suggesting that it had formed a view before hearing all the evidence, meant that its decision was not sound and raised an appearance of bias.

Mr Lewis was deputy head chef at New College Oxford ("New"). In 2007 he unsuccessfully applied for the Head Chef position, and subsequently learnt that one of the interview panel (a history don) wrote of him in terms quoting Voltaire that suggested he was lazy: something that Mr Lewis complained amounted to a stereotypical assumption about his Black Afro-Caribbean ethnic origin. In 2009 he was dismissed for (according to New) absences.
