Lewis v Rhyal Engineering [2005] EAT - compensation for failure to consult on redundancy
The EAT summary states:
"A dismissed for redundancy – unfairly (no consultation).
ET held:
(a) consultation could have proceeded during notice period
(b) the dismissal date would have remained the same
(c) A was entitled to compensation equivalent to the 3 weeks consultation would have taken
(d) there was no chance the dismissal date would have been extended and so no chance he would never have been made redundant.
