Li v Atkins & Gregory Ltd - No race discrimination in dismissal [2006] EAT

Ms Li, a cleaner of Chinese origin was dismissed for unsatisfatory performance. She claimed race discrimination. The Bury St Edmund's employment tribunal held that she had not establish even a prima facie case and so the burden of proof did not shift to the employer to demonstrate a non-racial reason for the dismissal - but even if it had, it was clear that race had nothing to do with her dismissal.
