Local Government Yorkshire & Humber v Shah - only employee, not worker, can receive compensation uplift for failure to follow ACAS Code

An uplift in compensation by 25%, which may be awarded by an employment tribunal for failure to follow the ACAS Code of Practice, is only available to an employee, not a worker.

Ms Shah, who was employed by the Bradford & Airedale PCT (B&A), was seconded to Local Government Yorkshire & Humber (LGYH) as a Project Director. She formed part of a Panel, under the auspices of LGYH, called Get Connected, run to combat extremism in the Muslim community. LYGH did not become her employer under these arrangements.
