Lomond Motors Ltd v Clark - Employers have wide measure of flexibility when selecting redundancy pool [2009] EAT

An employment tribunal found that Mr Clark, an accountant with a car sales firm, was unfairly dismissed when made redundant from Lomond Motors Ltd (LML). LML had four garages. Two ("LML West") were covered by one accountant, the other two ("LML East", which were taken over from another group) had two, one being Mr Clark. He had been posted there from his original location with LML West. LML intended that both halves of its business should now have only one accountant, and the pool for redundancy was Mr Clark and the other "East" accountant. Mr Clark was made redundant on the basis of his shorter length of service. 

He claimed that the selection of the pool was incorrect and it should have included all three accountants.
