London Borough of Barnet v Ferguson - Reasonable adjustments  EAT
Mrs Ferguson worked as an assistant in the Barnet legal department. She suffered from chronic fatigue syndrome. She was dismissed for incapability and claimed unfair dismissal. She also claimed that she was capable of doing less demanding work (eg as a secretary) and that the failure to offer her such work was a failure to make reasonable adjustments for her and was therefore unlawful disability discrimination.
The Watford employment tribunal found in her favour on both counts, awarding her £962 for unfair dismissal and £4,000 for disability discrimination.
